1. Service Description & Hosting Provider Status

PlayGaraj operates strictly as an independent, third-party User-Generated Content (UGC) hosting and listing provider. The Platform allows users to voluntarily share, publish, and browse listings related to virtual vehicles or custom design configurations.

• Hosting Infrastructure: The sole function of our Services is to provide a technical hosting infrastructure for user-submitted listings. We do not own, sell, trade, or distribute any virtual items, assets, or software related to any third-party game.
• Platform Independence: Our Platform is completely independent and is not authorized, endorsed, sponsored, affiliated, or officially connected with any game publishers, developers, or console manufacturers.
• Non-Interference: We do not modify game files, access game databases, alter official game economies, or violate the technical systems of any game.

2. Trademark & Intellectual Property Disclaimer

All brand names, trademarks, vehicle designs, game names, and visual assets displayed in listings on the Platform belong entirely to their respective intellectual property holders.

• Fair Use: References to game titles, vehicle brands, or game modes in user descriptions are purely descriptive, used solely for the purpose of identifying the context of the user-generated listing, and fall under fair use principles.
• No Partnership: PlayGaraj does not claim any ownership of the referenced game trademarks, and no official relationship or partnership is implied.

3. User Content & Responsibility

Every listing, image, text description, and communication shared on the Platform is the sole responsibility of the user who publishes it.

• Accuracy and Legality: The Platform does not pre-screen, verify, or guarantee the legality, safety, or accuracy of user-submitted content.
• Compliance: Users guarantee that their shared content does not violate any local laws, third-party rights, or the End User License Agreements (EULA) / Terms of Service of the respective game developers.
• Prohibited Activities: Users are prohibited from using the Platform to facilitate fraudulent activities, sell prohibited hacks/cheats, or distribute malicious software.
• Integration of Community Guidelines: In addition to these Terms, your use of the Platform is strictly governed by the PlayGaraj Community Guidelines. The Community Guidelines are hereby incorporated into these Terms by reference. Any breach or violation of the Community Guidelines constitutes a direct and immediate breach of these Terms of Service.
• Tiered Listing Framework & Unauthorized Commercial Activities: PlayGaraj operates a tiered marketplace framework. Users operating under a Standard Account are strictly restricted to publishing and listing virtual assets using the default in-game currency framework, designated as Game Money (GM). Standard accounts are strictly prohibited from soliciting, advertising, or requesting real-world fiat currency, external payment methods, or gift cards within listings or user-to-user communications. The capability to input a "Custom Offer" (allowing flexible value definitions including local or international fiat representations) is a premium privilege reserved exclusively for PRO Subscription tiers. Bypassing these tier restrictions by Standard accounts constitutes a direct violation of these Terms.

4. Limitation of Liability (Trades & Transactions)

PlayGaraj acts exclusively as a passive listing host and is not an active party to any interactions, negotiations, or trades between users.

• Financial Liability: The Platform does not process payments, escrow transactions, or facilitate virtual trades. We assume no responsibility or liability for agreements, financial transactions, scams, disputes, or losses resulting from user-to-user interactions.
• Game Account Status & Bans: Users acknowledge that using third-party platforms for listing game-related assets may violate the EULA or ToS of certain game publishers. PlayGaraj holds no liability for any actions taken by game publishers against user accounts, including account bans, suspensions, restrictions, or removal of in-game items. The user assumes all associated risks.
• External Communications: We have no control over communication, transactions, or agreements occurring outside the Platform (e.g., via Discord, WhatsApp, or Telegram). Any off-platform interactions are entirely at the user's own risk.

5. Account Suspension & Termination

Platform administration reserves the absolute right to suspend, restrict, or permanently terminate user accounts at its sole discretion, without prior notice, if scamming, fraudulent activity, or violations of these Terms of Service are detected.

• Confidentiality of Moderation Logs: To ensure the core safety of our network, maintain platform integrity, and protect user privacy—with absolute emphasis on the protection of minors—all internal moderation reviews, automated safety flags, verification logs, and raw chat transcripts are strictly proprietary and confidential. PlayGaraj is under no legal or operational obligation to disclose, share, or present unredacted logs or evidence to terminated accounts.

6. Acceptance & Changes to Terms

By using the Application, accessing the Website, or publishing listings on our Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. We reserve the right to update these terms at any time. Continued use of the Services indicates acceptance of any revised terms.

7. Governing Law & Jurisdiction

These Terms of Service and any disputes arising out of or related to the Services provided by VIZEYON shall be governed by, and construed in accordance with, the laws of Azerbaijan, without regard to its conflict of law principles. Any legal action or proceeding related to the Platform shall be brought exclusively in the courts of Azerbaijan.
